Professor Behan’s casebook should become the new standard for teaching Evidence. It provides the ideal blend of practical hands-on applications, thought-provoking problems, well-edited cases, and interesting scholarly excerpts. I highly recommend this casebook for teaching both large and small Evidence classes.
I taught from this text to a class of 56 students and received outstanding feedback. The book contains a straightforward presentation of black-letter evidence law, while challenging students to think critically about the policies behind the rules. The Applications allow the students to literally put the rules of evidence into practice, writing witness examinations and motions. Moreover, the problems highlight key aspects of the Federal Rules of Evidence, and the scholarly literature appropriately comments on both the good and bad in the rules.
Professor Behan clearly has designed this casebook with teaching in mind. The chapters are just long enough to cover in one class period, especially where Evidence is a 4-credit course taught twice a week. The teacher’s manual and answers to problems are thorough and user-friendly. And the variety of learning methods in the book make a 2-hour class pass by quickly and with great engagement from the students.
If you want to teach Evidence the way attorneys practice it, then Professor Behan’s book is definitely for you!
